I. For retired soldiers who have reported to the government resettlement department and have not yet been resettled for non-personal reasons, they should be arranged to organs, institutions, state-owned and state-owned holdings according to regulations, enterprises dominated by state-owned capital take up their posts. During the period to be settled, the local government shall issue Cost of Living supplement to the local residents according to the minimum living standard of the local residents in each year. Those who are willing to choose self-employment shall go through relevant formalities according to regulations.
II. If retired soldiers cannot take up their posts on time due to the reasons of receiving units, from the month when the local resettlement department issued the letter of introduction, the receiving unit shall reissue the living expenses month by month according to the standard of not less than 80% of the average salary of the personnel with the same conditions of the unit until they take up their posts.
III. For retired soldiers who have been resettled by the government, have not received a letter of introduction for personal reasons, or have arranged a job for the receiving unit, the original receiving unit is responsible for arranging their posts. Those who are not willing to take up their posts in the original receiving unit can apply for self-employment. For those who meet the relevant regulations, they can also choose retired soldiers to take up their posts in special public welfare.
IV. For retired soldiers who are on duty or unemployed after resettlement, their legitimate rights and interests should be protected in accordance with relevant national regulations: 1. For those who are waiting for work for non-personal reasons after placement and have not terminated the labor contract, from the date of issuance of the document, voluntarily terminate the labor relationship and self-employment, the enterprise shall go through the procedures for the dissolution of labor relations according to law; If there is a willingness to work in the special public welfare posts of retired soldiers and it conforms to relevant regulations, it can implement the special public welfare posts of retired soldiers; if you want to continue working in the original unit, you can wait for the unit to work after the situation improves. During the period of waiting for the post, the unit will pay the living expenses monthly according to the local minimum wage of 70%. 2. For those who are unemployed due to the bankruptcy and restructuring of the unit and other reasons, they shall enjoy the same treatment as the employees of the same working age and position in the unit according to the relevant provisions of the state. If wages are in arrears, they shall be paid off preferentially in accordance with the provisions of the Enterprise Bankruptcy Law of the People’s Republic of China. If I have the willingness to work in special public welfare posts of retired soldiers and comply with relevant regulations, I can give priority to special public welfare posts of retired soldiers. 3. For those who have difficulty in re-employment within 5 years from the legal retirement age, they can implement internal retirement after individual application, enterprise approval and agreement signed by both parties, apply for retirement formalities when reaching the legal retirement age. 4. For those who meet the conditions for early retirement due to illness, go through the early retirement procedures in accordance with the regulations.
V. Retired soldiers placed in the enterprise shall participate in the basic old-age insurance for enterprise employees according to regulations. For those who have not participated in the insurance payment at present, they can apply for the registration formalities of participating in the social insurance in the social insurance agency with valid proof; For those who are really difficult to pay the endowment insurance premium, if the local government coordinates the consultation between the Enterprise and the agency, signs an agreement and is included in the overdue payment management, and reaches the legal retirement age during the period, the individual payment part shall be paid by himself according to the regulations, and then the retirement formalities shall be handled for him; after being placed in the enterprise, they are in the state of unemployment and have not yet paid or interrupted the payment, so they are allowed to pay the endowment insurance as flexible employees. For retired soldiers who have participated in basic medical insurance, they shall be implemented in accordance with the provisions of the territorial basic medical insurance policy, and their military age shall be regarded as the payment period; For enterprises that have not participated in medical insurance, the local government urged them to participate in the local medical insurance according to the regulations. The Enterprise was responsible for solving the medical expenses incurred by the retired soldiers of the Army before the insurance. If the enterprise had difficulties in solving the problems and was unable to pay by himself and his family members, it should be incorporated into the urban and rural medical assistance system or solved through temporary assistance and other methods; For retired soldiers who close bankrupt enterprises, the problem of medical insurance participation should be solved in accordance with the provisions of the Enterprise Bankruptcy Law of the People’s Republic of China; for eligible unemployed retired soldiers, according to their time limit for receiving unemployment insurance benefits, the unemployment insurance agency shall pay the employee medical insurance fees and enjoy the employee medical insurance treatment; retired soldiers with flexible employment can participate in the employee’s basic medical insurance according to the insurance method of the local flexible employment personnel, and can also voluntarily participate in the basic medical insurance for residents.
Six, choose self-employment retired soldiers, self-employment one-time economic subsidies, retired before 2001, according to the standards of 2001; Retired after 2001, according to the standards of the year of retirement. For retired soldiers who are self-employed, the government should improve their employment ability through training, ensure that they enjoy preferential policies of self-employment and entrepreneurship, and encourage private enterprises with good benefits to hire retired soldiers first.
VII. For families of retired soldiers with difficulties in life, those who meet the minimum living guarantee conditions shall be included in the scope of minimum living guarantee, and temporary assistance shall be given to families with minimum living guarantee. Party committees and governments at all levels should include difficult families of retired soldiers into anti-poverty project and take one-on-one assistance measures to help them get rid of poverty.
VIII. For retired soldier families with housing difficulties, if they meet the conditions of urban housing security, the housing and urban construction department shall be responsible for establishing special ledgers, giving priority to solving their affordable housing, so as to ensure that they can be guaranteed.
9. For retired soldiers with employment ability, governments at all levels should vigorously open up employment channels and actively support their employment. At the same time, we should combine the local reality and do our best to develop special public welfare posts for retired soldiers as the base measures for the employment of retired soldiers. The development of special public welfare posts for retired soldiers can extend the time limit for government subsidies.
10. Strengthen vocational education and skill training for retired soldiers. Make full use of the educational resources of our province, formulate preferential policies, and list some higher vocational (higher vocational) plans in the spring college entrance examination, and draw separate lines for admission; In the separate enrollment of higher vocational colleges, arrange higher vocational colleges with higher school-running level, select superior subjects to recruit students for retired soldiers separately, and plan to admit them separately; Further improve the admission ratio of retired soldiers to college, and improve the exemption policy of retired soldiers to college during service, provide multiple channels for retired soldiers to receive higher education. According to the principle of voluntary participation, professional selection and free training, retired soldiers are encouraged to participate in vocational skills training to improve their employment and entrepreneurship ability.
Xi. For the funds needed to protect the legitimate rights and interests of retired soldiers, each city should establish a ledger on a person-by-person basis, summarize them by county (city, district) and report them to relevant provincial departments.
